End User License Agreement
This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and PulseOrion Health AI ("PulseOrion", "We", "Us", or "Our") governing your use of the PulseOrion mobile application, website, and related services (collectively, the "Service").
By installing, accessing, or using the Service, you agree to be bound by this EULA. If you do not agree, do not install or use the Service.
1. License Grant
Subject to your compliance with this EULA, PulseOrion grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, solely for your personal, non-commercial use.
2. License Restrictions
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Service
- Reverse engineer, decompile, disassemble, or attempt to derive source code
- Remove any copyright or proprietary notices
- Use the Service in any way that violates applicable law
- Access the Service to build a competitive product
- Use the Service for any unlawful or unauthorized purpose
3. Ownership
The Service, including all intellectual property rights, is and remains the sole property of PulseOrion Health AI. The PulseOrion name, logo, "✦" mark, Orion AI brand, and all related designs are trademarks of PulseOrion Health AI. This EULA does not transfer any ownership rights to you.
4. User Content
You retain all rights to health data, personal information, and content you submit to the Service. You grant PulseOrion a limited license to use, process, and store your content solely to provide and improve the Service. Refer to our Privacy Policy for details on data handling.
5. Updates & Modifications
PulseOrion may update the Service from time to time. Updates may be automatically installed on your device. We reserve the right to modify this EULA with notice (via the Service or email). Continued use after changes constitutes acceptance.
6. Term & Termination
This EULA is effective until terminated. PulseOrion may terminate your license immediately if you violate any terms. Upon termination, you must uninstall the Service and destroy all copies. Sections 2, 3, 6, 7, and 8 survive termination.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. PULSEORION DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. HEALTH-RELATED INFORMATION PROVIDED BY THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY — SEE OUR MEDICAL DISCLAIMER.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSEORION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO HEALTH-RELATED DECISIONS MADE BASED ON SERVICE OUTPUTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Third-Party Services
The Service may integrate with third-party services (Apple Health, Google Fit, etc.). PulseOrion is not responsible for the privacy, security, or performance of third-party services. Use of third-party services is governed by their respective terms.
10. Governing Law
This EULA is governed by the laws of India. Any disputes shall be resolved in the courts of Mumbai, Maharashtra.
